摘要/Abstract

摘要： 网络虚拟财产是一种新兴的财产,已经成为人们生活不可或缺的一部分。光明乳业发布了三款数字资产,标志着产业也开始迈向数字化,以后也会有各种各样的网络虚拟财产出现。然而我国《民法典》对网络虚拟财产的规定并不多,可见网络虚拟财产的法律保护机制并不健全。本文以光明乳业发布数字资产为出发点,对网络虚拟财产进行界定分析,对我国网络虚拟财产保护方面存在的不足进行分析,最终提出完善路径。

Abstract: Network virtual property is an emerging form of property that has become an indispensable part of our daily lives. Bright Dairy has released three digital assets,marking the beginning of the industry's move towards digitization. In the future,various types of online virtual assets will also emerge. However there are not many provisions on online virtual property in China's Civil Code, indicating that the legal protection mechanism for online virtual property is not sound. Starting from the release of digital assets by Bright Dairy,this paper defined and analyzed online virtual property, analyzed the shortcomings in the protection of online virtual property in China,and ultimately proposed improvement paths.
