乳制品配方的知识产权保护困境与实践路径

摘要: 乳制品配方作为乳品企业的核心竞争力,直接决定产品的质量与口感,相关权益保障对促进产业进步具有关键作用。当前,国内相关企业主要采取技术秘密和专利两种方式来维护配方权益,但各自存在不足。技术秘密方式易遭遇信息泄露隐患,且与消费端知情诉求难以协调;专利方式则面临技术易被模仿、授权标准严苛等挑战,限制了行业的良性发展。因此建议建立配方技术保密体系、丰富权益维护手段,以增加乳制品配方的知识产权保护,促进乳品企业的健康发展。

Abstract: As core competitiveness of dairy enterprises,dairy formulation directly determines the quality and taste of products,and the protection of relevant rights and interests plays a key role in promoting industrial progress.At present,domestic related enterprises mainly adopt technical secrets and patents to protect the rights and interests of formulas,but there are deficiencies in each.The technical secret method is prone to the hidden danger of information leakage,and it is difficult to coordinate with the consumer's demand for information.The patent method faces challenges such as easy imitation of technology and strict licensing standards,which restricts the healthy development of the industry.Therefore,it is suggested to establish a formula technology confidentiality system,adjust the patent examination standards,and enrich the means of rights and interests protection,so as to increase the intellectual property protection of dairy formulas and promote the development of the dairy industry.
