乳业包装装潢的法律保护边界问题研究——以伊利蒙牛纠纷案为例

摘要: 本文从经济法学视角,采用案例分析法,结合《反不正当竞争法》及相关司法解释,以2025年江苏高院审结的伊利诉蒙牛不正当竞争纠纷案为核心样本,探讨乳业包装装潢法律保护问题。研究聚焦“有一定影响的包装装潢”认定、包装近似性判断及消费者混淆可能性裁量,分析行业通用元素与个性化设计区分模糊三大实践困境。研究发现,乳业包装装潢保护需以“组合元素显著性”为核心,近似性判断应“整体优先、场景化比对”,混淆可能性认定需结合群体与渠道特性。同时研究提出“显著性要素组合认定体系”“多维度混淆可能性判断模型”等方案。[结论]指出,明确保护边界可遏制不正当竞争、留存行业创新空间,实现消费者权益、企业发展与市场秩序共赢,为裁判、合规及监管提供支撑。

Abstract: From the perspective of economic law, this paper adopted the case study method, and combines the Anti-Unfair Competition Law and relevant judicial interpretations. Taking the unfair competition dispute case of Yili v. Mengniu concluded by the Higher People's Court of Jiangsu Province in 2025 as the core sample, it discusses the legal protection of dairy product packaging decoration. The research focused on three practical dilemmas in judicial practice, including the identification of packaging decoration with certain influence, the judgment of packaging similarity, and the discretion of consumer confusion possibility, as well as the ambiguous distinction between general industrial elements and personalized designs.The study found that the protection of dairy packaging decoration should center on the distinctiveness of combined elements. The judgment of similarity shall follow the principle of overall priority and scenario-based comparison, and the identification of confusion possibility needs to be combined with the characteristics of consumer groups and sales channels. Meanwhile, this paper put forward corresponding optimization schemes, such as the identification system of distinctive element combination and the multi-dimensional judgment model of confusion possibility.It is concluded that clarifying the boundary of legal protection can curb unfair competition, reserve space for industrial innovation, achieve a win-win situation among consumer rights protection, enterprise development and market order, and provide theoretical support for judicial adjudication, enterprise compliance management and market supervision.
